The Startup Law (Ley 28/2022, de fomento del ecosistema de las empresas emergentes) has been finally published. Last Thursday, December 22, 2022 was published in the Official State Gazette (BOE). On Friday, December 23rd it came into force, which means that all the new features that the law incorporates are already being applied.
Main requirements for Spain digital nomad visa
Below you will find the main requirements to find out if you can apply for this type of visa:
- Be a qualified professional: to be a graduate, postgraduate, have a professional training diploma or have professional experience of at least 3 years in the job position.
- Work or provide services for a company or companies located outside Spain.
- Provide a job contract with the company of at least 1 year’s duration.
- Proof that the work activity can be performed remotely.
- Provide documentation showing that the employment relationship has existed for the last 3 months.
- Not having a criminal record in Spain or in the countries where you have resided during the last 2 years.
- To take out private medical insurance with a Spanish insurance company.
- Proof of minimum annual income from remote work (monthly 2.520€/ yearly 30.240€).
There are also specific requirements depending on whether you are employed or self-employed:
- If you are an employee:
- The company you work for must have at least 1 year of seniority.
- The company must sign an authorization to allow you to work remotely.
- If you are self-employed:
- You must provide services for at least one company.
- You can have a maximum of 20% of your income coming from Spanish companies.
